Under the Flood and Water Management Act 2010, “construction work which has drainage implications may not be commenced unless a drainage system for the work has been approved by the approving body”. The legislation applies to any building work or development which might affect the drainage of surface water, although official third parties will have a say on whether the drainage designs are adequate. Property owners must have some kind of drainage system in place.
It is the responsibility of the property owner to ensure water is drained properly into sewers and lateral drains connected to the public network. Local water companies are also sometimes responsible for completing maintenance or repair work on these sewers and drains.
Surface water drainage is the diversion or removal of excess water that collects on land surfaces. Some older properties will have a combined drainage system where a single sewer pipe is used to foul water and surface water.
